This agreement is entered into by , herein referred to as 'UNDERSIGNED' and THE BELLO GROUP, INC DBA CHIOMA, herein referred to as 'ORGANIZATION'.
I, Full Name (“Undersigned”), agree to electronic records and e-signature. My signature acknowledges that I have READ and AGREE the following.
I agree and consent that the completion of this form constitutes an authorized signature, acceptance and agreement to the terms and conditions of this agreement as if actually signed in writing. Further, I agree that no certification authority or other third party verification is necessary to the validity of electronic signature on this agreement. I agree that the lack of such certification or third party verification will not in any way affect the enforceability of the electronic signatures on this agreement or any resulting contract between myself and the Organization.
REFUND RELEASE
By signing this agreement and receiving the refund of $99 for MEMBERSHIP RENEWAL, the Undersigned agree and accept the following conditions:
- Release of Liability: I hereby forever release and discharge the Organization from any and all claims, demands, or causes of action, including claims of negligence, arising out of or related to the original transaction.
- No Admission of Wrongdoing: I understand that this refund is being made as a one-time courtesy exception to the Organization's "No Refund" policy and is not to be construed as an admission of liability or wrongdoing by the Organization.
- I agree to indemnify and hold harmless the Organization and its successors, assigns, and administrators from any and all claims, demands, or indemnity of any nature or character which may be claimed in the future by any person or entity as a result of the payment and refund made above. The Undersigned and related parties agree they shall not make, or cause to be made, any negative remarks, complaints, comments, reviews, or feedback regarding the Organization, its brands, or its affiliated companies. This provision does not prohibit the Undersigned from providing truthful information if required by law or to a government agency.
- By signing this agreement, I understand and agree that a refund request of $99 will be honored and this constitutes the entire and final resolution between the parties with regards to MEMBERSHIP RENEWAL REFUND AND ALL OBLIGATIONS and the terms of this agreement are contractual and enforceable.
- If the Undersigned violates any part of this agreement, the Undersigned will be considered in breach
of the agreement. The Organization may initiate legal proceedings in accordance with local and state regulations as well as seek judgement against the Undersigned for any damages. The Undersigned will be responsible for ANY and ALL legal costs arising from action taken as a result of violating the agreement.
- SEVERABILITY. If any provision of this Agreement shall be held or made invalid by a court decision, statute or rule, or shall be otherwise rendered invalid, the remainder of this Agreement shall not be affected thereby.
- GOVERNING LAW This Agreement will be construed in accordance with and governed by the laws of State of __Texas_______
